$26.5M Settlement in Aerospace No-Poaching Case Reported in Law360
07/18/2024Law360 has reported significant developments in the ongoing anti-poaching antitrust class action brought by nine former aerospace workers against RTX Corporation, Pratt & Whitney Division (P&W), and several engineering firms.
The article “Engineering Firms Ink $26M Deals to End ‘No-Poach’ Claims” details the $26.5 million settlement, which will be divided among the engineering firms as follows:
- $9.9 million from Belcan Engineering Group LLC
- $8.2 million from QuEST Global Services N.A.
- $7.4 million from Cyient Inc.
- $1 million from Agilis Engineering, Inc.
Parametric Solutions, Inc., which has filed for bankruptcy, will not contribute financially to the settlement but has agreed to provide additional discovery and cooperation. As settlements have been reached with five of the six defendants, P&W remains the sole defendant in the litigation.
The class action arose when it was discovered that P&W and the engineering firms conspired to restrict recruitment and hiring competition in the jet propulsion systems industry, leading to depressed salaries for highly skilled aerospace workers.
Attorneys David Slossberg, Erica Nolan, Timothy Cowan from HSSK, and co-counsel represent the named plaintiffs and the class.
The named plaintiffs have urged the judge to preliminarily approve the settlements, appoint a designated settlement administrator, and approve of the form and manner of notice to the proposed settlement class.
